Exempt And Nonexempt Classifications

Under the Fair Labor Standards Act (FLSA), all employees must be classified by their employers as exempt or nonexempt. All nonexempt employees are entitled to receive a minimum wage and must receive overtime pay that is 1.5 times their regular pay for each hour worked beyond the standard 40-hour work week.

Many employers incorrectly classify employees as exempt. Misclassifications by employers may be the result of confusion or they may be an intentional attempt on the part of an employer to cut costs.

If you think your rights under the FLSA may have been violated, contact Mezibov Butler in Cincinnati, Ohio. An experienced employment law attorney at our firm can review the facts of your case and help you determine if you may have a valid basis to pursue a claim against your employer.
