Protecting Your Rights Against Employer Retaliation

State and federal employment laws have been enacted to protect the rights of workers.   • Workers’ compensation retaliation: Your employer may not retaliate against you for filing a workers’ compensation claim. You may not be terminated, demoted, harassed or otherwise retaliated against for filing a workers’ compensation claim.
  • FMLA retaliation: If your employer has retaliated against you for seeking or obtaining leave under the Family and Medical Leave Act, your employer has acted in violation of federal employment laws and you may have a basis to obtain compensation and/or other vital relief.
  • ADA retaliation: Your employer may not discriminate against you for filing a disability discrimination claim or for seeking a reasonable accommodation under the Americans with Disabilities Act.
  • Title VII retaliation: You have a right to make a complaint or even file a lawsuit if you have been subjected to discrimination on the basis of race, color, sex, country of national origin or religion. In addition, your employer may not retaliate against you because you have made a complaint about sexual harassment.
  • Whistleblower retaliation: In specific circumstances, employees are protected when they make complaints about employer conduct that may violate federal or state laws.
